The protection of your personal data is of great importance to Almanach GmbH (hereinafter "Almanach" or "we"). Below, we inform you about the collection, processing, and use of your data in connection with the use of our website and services. 

2. Controller pursuant to Art. 4 No. 7 GDPR

Almanach GmbH, Kolonnenstraße 8, D-10827 Berlin, is the controller within the meaning of the General Data Protection Regulation (GDPR) for the processing of personal data on the website www.almanach.app and in the course of contract execution.

A data protection officer is not required for our company.

3. Collection and Processing of Personal Data

We collect and process personal data of our customers (schools, teachers, students) only to the extent necessary for providing our digital educational materials, processing orders, and optimizing our website. This includes, in particular, the following data:

·       Names and email addresses for providing access,
·       Payment and order data for contract execution,
·       Technical usage data of our website (see Section 6).

4. Legal Bases of Processing

The processing of personal data is carried out pursuant to Art. 6(1)(b) GDPR for the performance of a contract or pre-contractual measures. Additionally, processing may take place based on legitimate interests pursuant to Art. 6(1)(f) GDPR or with consent pursuant to Art. 6(1)(a) GDPR.

5. Hosting of Educational Materials

Our digital educational materials are hosted on the servers of the provider Common Ninja. In this process, personal data may be processed for technical provision pursuant to Art. 6(1)(b) GDPR and stored on servers in the USA.

We have concluded a data processing agreement (DPA) with Common Ninja pursuant to Art. 28 GDPR. Data transfers to third countries are based on standard contractual clauses.

6. Website Usage and Tracking

 6.1 Use of Semplice for Website Creation

Our website was created using the service "Semplice." In this process, technical data required for displaying the website may be collected. Processing is carried out pursuant to Art. 6(1)(f) GDPR, as we have a legitimate interest in the appealing design and presentation of our online offering.

6.2 Use of Google Analytics (with Consent)

We use Google Analytics with activated IP anonymization to analyze the use of our website. However, this is only done if you have given us your explicit consent via the cookie banner (Art. 6(1)(a) GDPR). Google Analytics uses cookies that enable an analysis of website usage. The collected information is processed in an anonymized manner and may be transmitted to and stored on Google servers in the USA. Data transfers are based on standard contractual clauses. You can withdraw your consent at any time with future effect by adjusting the cookie settings on our website.

We offer a newsletter, which we send using the platform ActiveCampaign (www.activecampaign.com). If you have subscribed to our newsletter, we process your name and email address pursuant to Art. 6(1)(a) GDPR for sending the newsletter.

ActiveCampaign stores your data on servers in the USA. We rely on standard contractual clauses to ensure an adequate level of data protection.

You can withdraw your consent at any time by clicking the unsubscribe link in the newsletter or by sending a message to privacy@almanach.app with future effect.

8. Data Sharing with Third Parties

Personal data is only shared with third parties if necessary for contract fulfillment or due to legal obligations. Any further sharing will not take place without your explicit consent.

9. Storage Duration and Deletion

We store personal data only as long as necessary for the respective processing purposes:

·       Contract data: 10 years (tax and commercial retention obligations),
·       Newsletter data: Until consent is withdrawn,
·       Google Analytics data: 14 months.

After the expiration of retention periods or upon user request, data will be deleted unless there are overriding legal retention obligations. We implement appropriate technical and organizational measures (e.g., encryption, access restrictions) to protect your data from unauthorized access.

10. Data Subject Rights 

You have the right to:

·       Access the stored data (Art. 15 GDPR),
·       Rectification of incorrect or incomplete data (Art. 16 GDPR),
·       Deletion of your data unless legal obligations prevent this (Art. 17 GDPR),
·       Restriction of processing (Art. 18 GDPR),
·       Data portability if processing is based on consent or a contract (Art. 20 GDPR),
·       Object to processing if we rely on legitimate interests (Art. 21 GDPR),
·       Withdraw consent given (Art. 7(3) GDPR).

11. Automated Decision-Making and Profiling 

We do not engage in automated decision-making or profiling pursuant to Art. 22 GDPR.
